One question I frequently ask supervisors in helping organizations gauge their readiness regarding basic Human Resources Compliance is this: Can you tell me step by step what the procedures are related to that process? If your supervisors, GM’s, and HR personnel cannot answer that question without hesitation, you have issues to address regarding basic legal readiness. The liability can be astronomical when we have not taken reasonable steps to prepare.
All of supervision and anyone else in a position of influence should know the basics regarding compensable time, lunchtime rules, family leave law, the ADA, and the required process for exempting employees (including the DOL’s 3 Factor Test as well as the required analysis in selecting an exemption). Did you know the DOL stated that if we have not conducted the proper process, our exempt employees can be re-classified as non-exempt? Anyone in these positions should also know the difference between an employee and a contractor and be familiar with the unique tests used by the state, the IRS, and the DOL. If your organizations “persons of influence” do not know these things you need to address these issues and I can help.

Kevin Macho Seminars offers a unique set of services regarding Active Shooter Training. During my public speaking travel, I frequently speak with front desk clerks at hotels, reception personnel in offices, and various other staff members in a variety of organizations. I usually ask one simple question. If a shooter entered your premises right now, what would you do? In well over 90% of my contacts, what I get is hesitation. No answer at all in the immediate. This cannot happen, but yet it does. This means that if a shooter enters, most of our personnel will have no reaction at all. That likely equals not only the loss of that employee’s life, but no notification whatsoever to the rest of the facility of the danger that is present.
Most organizations have not yet taken the steps to comply with OSHA’s General Duties Clause regarding Active Shooters. OSHA’s General Duties Clause requires that, in base, we identify reasonably predictable hazards and take steps to mitigate those hazards. Active Shooter incidents are one of those well-known hazards.
I developed a unique curriculum surrounding simple, 100 level concepts that are easy to learn and apply if the organization is truly committed to saving lives and protecting itself legally. It is not reasonable to train your people to the level of a police swat team. Your organization members can learn, however, to become proficient in simple, life-saving techniques that will put you and your organization on a completely different plain than most organizations who remain grossly underprepared.
